A citizen whose property is acquired by the State cannot be burdened with stamp duty or registration fees on an agreement allotting alternate property in lieu of compensation. Section 51 of the Land Acquisition Act covers such transactions. Karnataka High Court. 2026 Daksha Legal Kar 1003.

A tenant does not cease to be a tenant merely because he enters into an agreement to purchase the tenanted property unless there is express or implied surrender of tenancy. Money paid to a supplier towards the price of goods, including advance payment, becomes the supplier’s money as contractual consideration and is not held in trust or bailment. Failure to supply the goods after receiving payment may constitute a breach of contract, but not criminal breach of trust, in the absence of entrustment. Supreme Court.
